Urban renewal refers to the processes of revitalizing living spaces from social, physical, and economic perspectives. The goal of these projects is to create livable and sustainable cities. In this article, we will explore what urban renewal is and why it is important, and we will also examine in detail the conditions necessary for urban renewal to take place.<\/p>\n\n<h3 class=\"wp-block-heading\">What Is Urban Renewal?<\/h3>\n\n<p class=\"wp-block-paragraph\">Urban renewal refers to projects carried out in areas where living spaces are limited or pose risks. The goal of urban renewal projects is to minimize potential damage in the event of any adverse circumstances. With the enactment of Law No. 6306 on the Transformation of Areas at Risk of Disaster, urban renewal has gained even greater importance and has become an increasingly integral part of our lives. This law has introduced regulations that directly impact our lives, such as the identification and demolition of hazardous structures.<\/p>\n\n<p class=\"wp-block-paragraph\">According to Law No. 6306, a structure that has been demolished must be rebuilt in accordance with the zoning plan, and measures must be taken to ensure that the rightful owners are not disadvantaged. The area where the project will be carried out is determined by firms selected at the request of TOK\u0130 or the relevant authority. High-risk structures are defined as buildings scientifically determined to be at risk of collapse based on test results. The scope of application covers areas where high-risk structures, as designated by the Ministry, are located.<\/p>\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1000\" height=\"638\" src=\"https:\/\/www.gokozinsaat.com\/wp-content\/uploads\/2023\/07\/kentsel-donusum-nedir-kentsel-donusum-sartlari-nelerdirblogici.jpg\" alt=\"\" class=\"wp-image-14786\" srcset=\"https:\/\/www.gokozinsaat.com\/wp-content\/uploads\/2023\/07\/kentsel-donusum-nedir-kentsel-donusum-sartlari-nelerdirblogici.jpg 1000w, https:\/\/www.gokozinsaat.com\/wp-content\/uploads\/2023\/07\/kentsel-donusum-nedir-kentsel-donusum-sartlari-nelerdirblogici-300x191.jpg 300w, https:\/\/www.gokozinsaat.com\/wp-content\/uploads\/2023\/07\/kentsel-donusum-nedir-kentsel-donusum-sartlari-nelerdirblogici-768x490.jpg 768w\" sizes=\"auto, (max-width: 1000px) 100vw, 1000px\" \/><\/figure>\n\n<h3 class=\"wp-block-heading\">What Are the Criteria for Urban Renewal?<\/h3>\n\n<p class=\"wp-block-paragraph\">Certain conditions must be met for urban renewal projects to be carried out. First, core samples must be taken from various points of the building by an organization approved by the Ministry of Environment and Urbanization. Based on the test results, an application must be submitted to the Land Registry Office to confirm that the building is at risk. Subsequently, the Land Registry Office must notify the apartment owners of the relevant report via official notice. Apartment owners have the right to appeal the decision within 15 days of receiving the notice. Following the appeal, the process is finalized by a commission composed of four experts and three ministry representatives. Once the report is finalized, the apartment owners must obtain a report from a firm licensed by the Capital Markets Board. After the report is prepared and the agreements are finalized by the apartment owners, a contract is signed with the contractor with whom an agreement has been reached, and construction begins.<\/p>\n\n<h4 class=\"wp-block-heading\">How Are High-Risk Buildings Identified in Urban Renewal Projects?<\/h4>\n\n<p class=\"wp-block-paragraph\">Teams authorized by the ministry to assess the risk status of buildings conduct the necessary tests on these structures and prepare reports. Other necessary procedures are carried out in accordance with the report. Urban renewal projects are more common in areas with high levels of unplanned urbanization. The identification of high-risk structures is carried out following applications by apartment owners to the relevant authorities. Additionally, risk assessment may be conducted during an inspection carried out by the Ministry. The demolition of high-risk structures is mandatory under Law No. 6306.<\/p>\n\n<h4 class=\"wp-block-heading\">What Should Be Done After a High-Risk Building Is Identified?<\/h4>\n\n<p class=\"wp-block-paragraph\">If your building is deemed a high-risk structure following the risk assessment, it will be demolished. The property owners will be given 60 days; if demolition does not take place within this period, the property owners will be required to cover the demolition costs.<\/p>\n\n<p class=\"wp-block-paragraph\">Following the risk assessment, the building owners become co-owners of the land in proportion to their shares as recorded in the land registry. At this stage, a building co-ownership agreement is drawn up to determine how the building will be divided and in what proportions. The shares of building owners who do not participate in the building\u2019s joint protocol are sold to other co-owners through an auction. If no buyer is found for these shares, the ministry purchases them through expropriation.<\/p>\n\n<h4 class=\"wp-block-heading\">What Documents Are Required for an Urban Renewal Application?<\/h4>\n\n<p class=\"wp-block-paragraph\">The following documents are required for urban renewal projects:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Application form bearing a wet signature<\/li>\n\n\n\n<li>Copy of ID card <\/li>\n\n\n\n<li>A risk assessment report for a building approved by the Ministry<\/li>\n\n\n\n<li>A copy of the title deed and the current title deed record<\/li>\n\n\n\n<li>Any of the fixed bills, such as electricity, water, gas, and internet<\/li>\n\n\n\n<li>A signed and sealed report from the Provincial, District, and Citizenship Directorate stating that the hazardous building has been evacuated<\/li>\n\n\n\n<li>A form bearing a wet signature and seal certifying that the structure has been demolished<\/li>\n\n\n\n<li>A Ziraat Bank checking account statement for the apartment owner<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">How Is Urban Renewal Carried Out?<\/h3>\n\n<p class=\"wp-block-paragraph\">For a planned project to be launched, the area must have been zoned for development by the government. In urban renewal projects, the process is managed by the apartment owners, though they also have the right to grant power of attorney to a contractor. The urban renewal process proceeds as follows:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>First, a risk assessment of the structure is conducted.<\/li>\n\n\n\n<li>In order to conduct a risk analysis, apartment owners must have authorized companies perform the risk analysis.<\/li>\n\n\n\n<li>Once the risk report has been approved, it is communicated to the apartment owners.<\/li>\n\n\n\n<li>Following the risk notification, apartment residents are given 60 days to vacate the building.<\/li>\n\n\n\n<li>A two-thirds majority is sufficient to demolish and rebuild the building. For the remaining one-third, the ministry initiates a purchase process.<\/li>\n\n\n\n<li>Once the sales process is complete, the contractor obtains the necessary permits and begins construction.<\/li>\n\n\n\n<li>Once construction is complete, the project is finalized upon obtaining the occupancy permit.<\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\">In Which Areas Is Urban Renewal Carried Out?<\/h4>\n\n<p class=\"wp-block-paragraph\">The areas where urban renewal projects are to be implemented must be approved by the ministry. Since the primary goal of urban renewal is safety, the necessity of the project depends on factors such as the soil structure, problems caused by existing development, and earthquake risk. Urban renewal should be carried out in areas deemed risky in terms of life and property safety. Urban renewal projects are also referred to as \u201cin-place renewal.\u201d The term \u201cin-place renewal\u201d is generally used in the context of the renewal of standalone buildings. In this method, the existing building is demolished and rebuilt as an identical structure.<\/p>\n\n<p class=\"wp-block-paragraph\">Urban renewal projects are crucial for making the cities we live in more livable.
